Liability Waiver & Release of Liability
PLEASE READ CAREFULLY. BY PURCHASING A TICKET AND CHECKING THE REQUIRED BOX AT CHECKOUT, YOU ARE AGREEING TO THE TERMS OF THIS COMPREHENSIVE RELEASE AGREEMENT.
In consideration for being permitted to participate in any paint night, private event, workshop, or activity (collectively, the "Event") hosted or conducted by Studio 5•Two•5 (including its owners, hosts, instructors, and operators, hereinafter referred to as the "Studio") at its residential premises located in Worth Township/Metamora, Illinois, I, the participant (and on behalf of my heirs, executors, administrators, and assigns), hereby agree to the following terms:
1. Voluntary Participation & Assumption of Risk
I understand that my participation in the Event is entirely voluntary. I acknowledge that the Event takes place on a private residential property and involves certain inherent risks, including but not limited to:
• Navigating a long, 140-foot private gravel or paved driveway, walkways, and residential steps, which may present tripping hazards, uneven surfaces, or weather-related slip conditions.
• The use of art supplies, including acrylic paints, solvents, chemical pigments, sharp brushes, and tools, which can cause skin irritation or damage to personal belongings and clothing.
• The consumption of food, appetizers, snacks, and non-alcoholic mocktails prepared or provided by the Studio.
I knowingly, freely, and voluntarily assume all such risks, both known and unknown, associated with my attendance and participation in the Event.
2. Release and Waiver of Liability
I hereby release, waive, forever discharge, and hold harmless Studio 5•Two•5, its property owners, hosts, instructors, family members, and affiliates from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my participation in the Event. This includes, without limitation, any claims for personal injury, illness, disability, death, or property damage/loss, whether caused by the ordinary negligence of the Studio or otherwise.
3. Medical Conditions & Food Allergies
I acknowledge that it is my sole responsibility to notify the Studio in writing prior to the Event regarding any severe food allergies, dietary restrictions, or medical conditions that could be triggered during the Event. While the Studio takes care in preparing themed finger foods and mocktails, it operates in a residential kitchen and cannot guarantee an allergen-free environment (including cross-contamination of nuts, dairy, gluten, or other allergens). I assume all risks regarding any allergic reactions I may experience from foods or beverages consumed at the premises.
4. Property Damage & Stains
I understand that protective fabric aprons are provided by the Studio as a courtesy; however, acrylic paint is permanent once dried and can stain clothing, shoes, jewelry, and personal items. I agree that the Studio is not responsible or liable for any damage to my personal property or attire brought onto the residential premises.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Studio from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the Event, or caused by my own negligent or intentional actions during the Event.
6. Governing Law
This Waiver and Release of Liability shall be governed by, construed, and enforced in accordance with the laws of the State of Illinois. If any portion of this agreement is held to be invalid or unenforceable by a court of law, the remaining portions shall continue in full legal force and effect.
Acknowledgment of Understanding
By checking the mandatory agreement box at checkout, I certify that I have read this document in its entirety, fully understand its terms, and recognize that I am giving up substantial legal rights, including the right to sue the Studio and its property owners. I acknowledge that checking the box serves as my digital signature and a complete and unconditional release of all liability to the greatest extent allowed by Illinois law.
